Excavation Statement

In the specific area of underground excavation, (__________Company) supports, follows and ensures compliance with all California Excavation Laws, i.e., California Government Code 4216 and Cal/OSHA Title 8 Construction Safety Order Chapter 4, Subchapter 4, Article 6, Section 1541. (__________ Company) supports, follows and ensures compliance with Underground Service Alert (USA) and the requirements to "Call before you dig." All employees of (__________ Company) are trained on the excavation standards and understand that compliance with these rules is a condition of employment.

Training Program

(Please include your exact training program around excavation as an attachment)

(__________ Company) conducts new hire training as well as refresher training for all employees. Training and/or refresher training is conducted to ensure knowledge of the rules, regulations and laws involved in the required work. Relevant to the "One Call Law" ? employees are provided with the requirements of California Government Code 4216 and Cal/OSHA Title 8 Construction Safety Order Chapter 4, Subchapter 4, Article 6, Section 1541.

"I, employee name (____________) at (__________Company) am aware of, understand, and will comply with the Damage Prevention Policy and its associated training and requirements. This includes:

1) A current valid USA ticket will be on all jobsites (whether electronic or paper)

2) USA tickets will be renewed before the expiration date 3) (Company) will establish and maintain a 2-foot tolerance zone from the

outer edge of the facility and proper use of hand tools/power operated excavation equipment will be observed. No power operated equipment will be used without the prior express permission of the operator(s). 4) (Company) will maintain marks on the ground throughout the duration of the project as needed. 5) If the utility cannot be found, (Company) will halt that portion of the project and call 811 and operator.

One Call Law Testing Frequency:

All New Hires are trained/tested at orientation and must pass knowledge test before any field work takes place. Once an employee signs that he/she has been trained, they acknowledge compliance with its requirements.

Statement Sample: "All employees working on excavation-related activities at (________Company) are trained on an (________) basis.

Corrective Action Plan

(__________ Company) is committed to "safety first" in the performance of all jobs. (__________ Company) supports, follows and ensures compliance with all California Excavation Laws, in accordance with California Government Code 4216 and Cal/OSHA Title 8 Construction Safety Order Chapter 4, Subchapter 4, Article 6, Section 1541. (__________ Company) supports, follows and ensures compliance with Underground Service Alert (USA) and the requirements to "Call before you dig."

Below is process for identifying root causes, i.e. reasons for dig-in and/or unsafe excavation practices and their associated corrective measures.

(Company) will investigate all incidents including the following: ? Photos and/or videos will be taken from different angles (This ensures you can validate that incident/damaged pipe was at that location on that day, in that condition). ? Statements from all crews and personnel on scene ? Measurements as needed ? Weather conditions will be noted

(__________ Company) will investigate any/all breaches of the One Call Law process. To that end, each case will be adjudicated individually. However, each case investigation will follow specific guidelines as listed here:

Investigation Team: Involved Employee(s), Supervisor, Safety Director and Manager. (This is the minimal makeup of the investigative team. Depending on accident/issue, more individuals may be involved)

Investigation Process: Gather Facts ? What happened, When did it happen, How did it happen, Where did it happen and Why did it happen?

Investigation Outcome/Decision: Based on facts of case, a decision will be rendered. Outcome/Decision will determine cause of accident/issue and appropriate case specific remedy. Outcome/Decision may involve disciplinary action ? further training, counseling, verbal/written warning, suspension or termination (all dependent on individual case details).

Investigation Path Forward: Accident/incident/issue investigation outcome will be provided to all employees. This will include what caused the problem, how the problem should have been avoided and what to do if a similar issue arises.

Additionally, events will be logged into the California Regional Common Ground Alliance (CARCGA) Damage Information Reporting Tool (DIRT) at: within 30 days of an incident.

Events are registered to provide root cause of facility event, help determine why the event occurred by analyzing the data, improve excavation standards, ensure the safety and protection of people and underground infrastructure and help educate all stakeholders so that damages can be reduced through effective practices and procedures.

Employee Acknowledgement and Accountability

Option 1:
